Local planning authorities are required to compile and maintain a Brownfield Land Register under the Town and Country Planning (Brownfield Land Register) Regulations 2017(link is external).
The purpose of the Brownfield Land Register is to provide details on sites that the local planning authority considers to be appropriate for future residential development. It allows potential developers to easily identify the land within the Tendring District that is readily developable.

˜Brownfield' land (previously developed land) is defined in Annex 2 of the National Planning Policy Framework(link is external) as:
"Land which is or was occupied by a permanent structure, including the curtilage of the developed land (although it should not be assumed that the whole of the curtilage should be developed) and any associated fixed surface infrastructure. This excludes land that is or has been occupied by agricultural or forestry buildings; land that has been developed for minerals extraction or waste disposal by landfill purposes where provision for restoration has been made through development control procedures; land in built-up areas such as private residential gardens, parks, recreation grounds and allotments; and land that was previously developed, but where the remains of the permanent structure have blended into the landscape in the process of time."

Given the purpose of the Brownfield Land Register, it does not include sites with planning permission that were under construction at the time of publication. The regulations require the register to be kept in two parts and be updated at least once a year:
Part One of the Brownfield Land Register will comprise all brownfield sites that a local planning authority has assessed as appropriate for residential development.
Part Two of the Brownfield Land Register is a subset of Part One. Part Two will comprise only those sites in Part One that the local planning authority has decided would be suitable for a grant of permission in principle for residential development. The Council has not considered sites for inclusion in Part Two of the register at this stage.
